Wrongful death suit filed

Post by dbrackin7 » Wed May 01, 2013 4:19 pm

The news report claims Thomas A. Janero is filling suit against Norfolk Southern and CSX. How is CSX responsible in any way when to my knowledge they don't have any trackage in montpelier, IN?

While I feel sorry for his loss of his Family we must remember that they're decisions that we must make everyday that could shape the rest of your Life, Choose Wisely ! Yes it was a wrongful death, on her Part....

I feel badly too for the families I have also been at that railroad crossing multiple times, but im still wondering where CSX comes into play in this lawsuit.

Notch,

his wife wasn't driving, which makes this suit even more dubious. Her mistake was not wearing a seatbelt or securing the car seat. While I feel for the guy, this suit will not make anyone feel better. (except for the lawyers)

Drew,
I think the lawyer is just naming anyone he can think of to see who offers a settlement. Not sure, but maybe NS was using a CSX locomotive that day?

The borrowed power would make a little sense, either way its a sad situation that didn't need to happen.
